This End User License Agreement ("EULA") is a legal agreement between you and My Complex regarding your use of the mycomplex.au mobile application for iOS and Android devices ("Application").
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on compatible mobile devices owned or controlled by you, strictly in accordance with these terms and the terms of service of the Apple App Store or Google Play Store.
2. Third-Party Beneficiaries (Apple and Google)
You explicitly acknowledge and agree that:
- This EULA is concluded solely between you and us (the developer), not with Apple Inc. or Google LLC.
- We, and not Apple or Google, are solely responsible for the Application, its content, maintenance, and support services.
- To the maximum extent permitted by law, Apple and Google have no warranty obligations whatsoever with respect to the Application. Any claims, losses, liabilities, damages, or costs attributable to any failure of the app are the sole responsibility of us as the developer, governed strictly by the liability limits set out in our master Terms of Service.
3. Intellectual Property & Security Protections
The Application binaries, asset trees, compile files, and native systems are the proprietary intellectual property of My Complex. You explicitly agree that you will not, under any circumstances, attempt to decompile, reverse engineer, extract elements of, or bypass security validation matrices embedded within the mobile application package.
4. Acceptable Use and Marketplace Code of Conduct
The Application contains public areas, including a peer-to-peer communication marketplace. You are strictly prohibited from utilizing the mobile application to upload, distribute, or list content that:
- Is unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, or obscene.
- Promotes illicit activities, illegal substances, or counterfeit items.
- Infringes upon the intellectual property or privacy rights of any resident, contractor, or third party.
We reserve the absolute right to monitor user-generated listings and instantly, without notice, remove offending items or permanently terminate the account access of any mobile user found in violation of these rules.
5. System Uptime and Push Communications
The Application utilizes background device tokens to transmit critical operational push alerts (e.g., fire drill alerts, package delivery notifications, marketplace updates). While all technical care is executed, we do not guarantee uninterrupted delivery of push alerts, as delivery depends on independent cellular networks, hardware status, and operating system vendors.
6. Device Integrity & Telemetry Disclaimers
The Application requires background data routing, processing architecture, and device telemetry to successfully execute push tasks. Users acknowledge that My Complex is not liable for data overage parameters, device battery degradation, or processing thermal issues resulting from the execution of the background frameworks.
7. Age Demographics & Sanctions
By executing the mobile setup parameters, you verify that you are not located in a nation subject to active international trade embargos and that you are at least 18 years of age (or possess verified parental/guardian permission to utilize local building tools).
